Implementation of the Legal Aid to the Poor

The Legislative Department is related with the implementation of the Legal Aid to the poor for that purpose,the Assam State Legal Service Authority, was constituted vide Notification LGL.176/94/pt.II/47, dated 7th April, 1998. It is a statutory body constituted under section 6 of the Legal Services Authorities Act, 1987 (Central Act No.39 of 1987) read with rule 3 of the Assam State Legal Services Authority Rules, 1996. Chief Justice of Gauhati High Court is the Patron in Chief of the Authority and a serving Judge nominated by the Governor in consultation with the Chief Justice of the High Court is the Executive Chairman, Advocate General, Assam, the Secretary Finance department to the Govt. of Assam, Secretary, Legislative (Law) Department, Director General of Police are Ex-Officio member of the Authority along with other nominated members.

State Government in consultation with the Chief Justice of the High Court, appoint a person belonging to the State Judicial Service not below the rank of a District Judge as a Member Secretary of the State Authority to exercise the power and functions of the Authority under the executive Chairman of the State Authority.

The State Authority exercise the functions assigned to it under Legal Services Authorities Act, 1987 and rules made thereunder.

The duty of the State Authority is to give effect to the policy and directions of the National Legal Service Authority. The Authority provides legal service to persons as per provision laid down in the Act. It conducts Lok Adalat and undertake preventive and strategic legal aid programmes and perform such other functions as assigned by Central Authority and by rules and regulations made under the Act.

To discharge the functions of the State Legal Authority, State Government under the provisions of the Legal Services Authorities Act, 1987 provides necessary posts to discharge the functions under the Act and the rules and regulations framed thereunder.

Under the Legal Services Authorities Act, 1987, District Legal Services Authorities are also constituted vide Govt. Notification No.LGL.176-94/pt-II/48, dated 7th April, 1988 for 21 Judicial districts to perform the functions of legal service as assigned by the Legal Services Authority Act, and the Rules and Regulations made thereunder. The District Authority consists of District judge, District Magistrate, Superintendent of Police, Chief Judicial Magistrate, District Government pleader as Ex-Officio members and these members are nominated by the State Government in consultation with Chief Justice of the High Court.

The District Authority coordinate the activity of Sub-divisional Legal Services Authority and other legal services in the district and organise Lok Adalat and perform such other functions as assigned to them by the State Authority.

To perform the activity of the District Legal Services Authorities Government creates posts for the said District Authority in the district. D.L.S.A. in each district has the following staff:-

Under Legal Services Authorities Act, 1987, Sub-divisional Legal Services Committees in the Sub-divisions of Bajali, Hojai, Rangia and High Court Legal Services Committee are also constituted for discharging functions under the Legal Services Authorities Act, 1987.
